While some say that the only thing certain about litigation is its uncertainty, we have a SUPERB record of success. This has allowed us to realize our firm philosophy - DELIVERING EXCELLENT RESULTS in the most EFFICIENT manner. Among our recent SUCCESSESare:

• Our client, a London-based apparel distributor, was sued for $1 million for breach of an exclusive distribution agreement. We counterclaimed for $1.97 million for breach of the agreement. After a two week binding international arbitration we won an award of $1.97 million for our client, and got a defense award on the claimant's claim.

• Successful prosecution of litigation on behalf of holder of restricted stock valued at over $2.5 million against issuer refusing to permit removal of restrictive legend on the stock. Through this and other cases, our firm has developed a special expertise involving restricted stock, SEC Rule 144, and stock transfer agent law.

• Co-lead counsel in lawsuit against a nationalbroker-dealer, certified on behalf of investors who purchased stocks under a "commission-free" trading program during the years 1993-1997. After a three-week trial, the case settled during jury deliberations for $21 million, which represented a recovery of over 115% of the class' net out-of-pocket losses.

• Our client was sued by an insurance carrier for $500,000.00 for back premiums. After formulating and implementing a successful challenge before the Department of Insurance, our client paid a very nominal amount in settlement of the claim.

• Successful prosecution and resolution of "cyber-smearing" case involving defamation against our client on the Internet.

• Successful defense of a breach of contract suit filed against a telecommunications company. Before we were retained as counsel, our client had offered a six-figure settlement, which the plaintiff rejected. After we undertook the representation, the plaintiff agreed to settle the matter for a complete walk-away. Our client paid the plaintiff nothing.

• Victorious defense in arbitration of securities related breach of contract claim for $1.5 million on behalf of publicly-traded company, with potential recovery of all attorney fees incurred by the defendant.

• Lead counsel in a class action certified on behalf of investors who bought stock in a private placement offering. The case settled before trial for a recovery of over 80% of the investors' out-of-pocket losses.

• Successful defense of a securities class action on behalf of an individual director of a publicly-traded company, in an action filed in state court. We acted as lead defense counsel in defeating plaintiff's motion for class certification.

• Successfully represented several individuals and entities in matters against the Securities and Exchange Commission. In one case, we prevailed at trial on behalf of a broker-dealer sued by the SEC in an administrative enforcement action. In several other cases, we negotiated waivers of civil penalties and digorgement.
